Why do I need a conveyancer?

Your legal professional will complete various tasks to advance to a point where you are able to exchange contracts and subsequently complete your purchase or sale.

If you are buying, your solicitor or qualified conveyancer will ensure you are acquiring a property that is legally sound and as marketed, i.e. that the seller is the owner and has the right to sell the property and that there is no issue that could restrict its re-sale potential or your ability to get a mortgage.

When selling, your conveyancer will provide answers, evidence and legal documents that satisfy the demands of the buyer's representative.

We recently used Scott Fraser to sell and buy. Owen was helpful, communicative, and a genuinely nice person. I would highly recommend.

Conveyancing FAQs

A conveyancer handles all legal aspects of transferring property ownership. For buyers, this includes conducting property searches, reviewing the contract, arranging mortgage funds, registering the property with the Land Registry, and handling stamp duty payments. For sellers, they prepare the contract, answer legal questions about the property, and manage the transfer of funds.

The average conveyancing process takes 12-16 weeks, though this can vary depending on the complexity of the transaction, the length of the property chain, and whether any unexpected issues arise. Our legal partners prioritise efficiency while ensuring all proper checks are conducted.

Standard searches include Local Authority searches (planning permissions, building regulations, and local developments), Environmental searches (contamination, flooding risks), Water and Drainage searches, and Land Registry searches. Additional searches may be required depending on the property's location and circumstances.

Conveyancing costs typically include legal fees (our partners offer competitive fixed fees), disbursements (third-party costs like search fees and Land Registry fees), and potential additional fees for services like telegraphic transfers. You'll receive a clear breakdown of all costs before proceeding.

On completion day, your conveyancer transfers the remaining purchase funds to the seller's solicitor. Once received, the seller's solicitor confirms completion and releases the keys. Your conveyancer then handles the post-completion formalities, including paying any stamp duty due and registering the property in your name with the Land Registry.
